1. Who We Are

Nutrinergy VOF (“2fuel”, “we”, “us”, or “our”), a general partnership (vennootschap onder firma) under Dutch law, provides a sports nutrition platform consisting of the 2fuel mobile application, the 2fuel website (2-fuel.com), and related services that connect athletes with independent nutrition coaches, dietitians, and teams (together, the “Service”).

These terms and conditions (“Terms”), together with our Privacy Statement, govern your access to and use of the Service. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Medical Disclaimer

2fuel provides general sports nutrition guidance for informational and educational purposes only. It does not provide medical advice, diagnosis, or treatment.

• The Service is not a substitute for consultation with a physician, dietitian, or other qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of information obtained through the Service.
• Consult a healthcare professional before starting any new nutrition or training program, before making significant changes to your diet, if you have any pre-existing health condition (including diabetes, cardiovascular conditions, kidney conditions, or a history of disordered eating), if you are pregnant or breastfeeding, or before taking any supplements.
• The Service is intended for healthy adults. It is not intended for minors, pregnant women, or individuals with medical conditions requiring supervised nutrition.
• Individual responses to dietary and training changes vary. We do not guarantee any specific outcome, result, or performance improvement.
• If you experience faintness, dizziness, pain, or shortness of breath during exercise, stop immediately and seek medical attention. In an emergency, contact your doctor or emergency services immediately.

Your use of the Service and your participation in any training or nutrition program is at your own risk.

3. Eligibility

To use the Service you must be a natural person aged 18 or older. By using the Service you confirm that you meet this requirement. The Service is not directed at, and may not be used by, anyone under 18.

4. Your Account

• To use the Service you must register an account, via the app (Apple App Store / Google Play) or the website.
• You guarantee that the information in your profile is complete, accurate, and up to date, and that you keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at info@2-fuel.com of any unauthorized use of your account. We are not liable for loss resulting from unauthorized use of your credentials.
• You may not create multiple accounts without authorization, share your account with others, or impersonate any person or entity.

5. The Service

2fuel calculates personalized sports nutrition guidance around your training: based on your planned sessions (sport, duration, intensity) and your profile data, the app calculates energy and macronutrient recommendations and translates these into a day plan — before, during, and after training. The Service further includes, depending on your plan:

• meal and fueling plans built around your training schedule;
• integrations with third-party training platforms and activity trackers (see section 12);
• a platform connecting athletes with independent nutrition coaches, dietitians, and teams;
• tools for coaches and teams to manage and guide their athletes and clients;
• content such as recipes, articles, and educational material.

We continuously develop the Service and may add, change, or remove features at any time. Where a change materially reduces the core functionality of a paid plan, section 19 (Changes) applies.

6. Coaches and Teams

• 2fuel is a platform. Coaches, dietitians, and team staff on the platform (“Coaches”) are independent professionals or organizations; they are not employed by, or agents of, 2fuel.
• The agreement for coaching services is between you and the Coach. 2fuel is not a party to that agreement and is not responsible for the content, quality, or outcome of coaching, or for disputes between athletes and Coaches.
• 2fuel does not verify and does not guarantee that a Coach holds any particular license, registration, or qualification, or that a license held in one jurisdiction is valid in yours. Relying on a Coach’s advice is at your own risk.
• If you offer services as a Coach through the Service, you represent and warrant that you are qualified and, where required, licensed for the services you provide in the jurisdictions where you provide them, and that you comply with all professional and legal obligations applicable to you (including confidentiality and data protection obligations towards your clients).

7. Subscriptions, Prices, and Payment

Payment methods. Paid plans can be purchased (i) through the Apple App Store or Google Play (in-app purchase), or (ii) directly from us via our website, with payment processed by our payment provider Stripe or by direct payment (e.g., bank transfer or invoice).

App store purchases. Subscriptions purchased through the Apple App Store or Google Play are billed by, and subject to the payment and refund terms of, the relevant app store. Manage or cancel these subscriptions in your app store account settings.

Direct purchases. For purchases made directly from us, the prices, billing period (monthly or annually), and plan contents stated at checkout apply. Plans renew automatically per billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid for the current billing period are not refunded, except where mandatory law provides otherwise.

Prices and VAT. Prices for consumers are stated including VAT. Prices for coach and team plans (business customers) are stated excluding VAT; Dutch VAT (21%) or the applicable reverse-charge mechanism applies.

• You must pay all fees due for your use of paid parts of the Service. If you fail to pay on time, we may suspend or terminate your access to the paid Service, without prejudice to our right to claim payment and damages.
• We may change our prices. Price changes take effect no earlier than the next billing period and we will notify you at least one month in advance. If you do not accept a price increase, you may cancel before it takes effect.
• Free trials (such as the 3-week coach trial) end automatically when the trial period ends and do not convert to a paid plan, unless expressly stated otherwise at sign-up.

Right of withdrawal (consumers). If you are a consumer in the EU and purchase a subscription directly from us (not via an app store), you have a statutory right to withdraw within 14 days of purchase without giving a reason. If you ask us to start providing the digital service during the withdrawal period, and you then withdraw, you owe a proportionate amount for the period already provided; you acknowledge that the right of withdrawal lapses once the service has been fully performed with your prior express consent.

8. Beta Access

We may give selected users free access to the Service or to specific features for testing purposes (“Beta Access”).

• Beta Access is provided free of charge in exchange for your active use of the Service and your feedback.
• We may limit, suspend, or revoke Beta Access at any time and at our sole discretion, including if you do not actively use the app or do not provide feedback.
• Beta features are provided “as is”, may contain errors, may change or be discontinued without notice, and data generated during Beta Access may be modified or deleted.
• Beta Access does not entitle you to any (continued) free use of the Service, and no rights can be derived from features available during Beta Access.
• Feedback you provide may be used by us without restriction or compensation to improve and develop the Service.

9. License and Restrictions on Use

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own (or, for Coaches and teams, your internal professional) purposes, in accordance with these Terms.

You may not, and may not enable or assist anyone else to:

• use the Service for any commercial purpose outside the scope of your plan without our express consent;
• copy, modify, distribute, sell, lease, reproduce, or publicly disclose (any part of) the Service or its content, except as permitted by these Terms or mandatory law;
• reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent mandatory law permits this;
• access the Service through automated means (bots, scrapers, spiders), or retrieve and reuse a substantial part of the Service’s content, or repeatedly and systematically retrieve non-substantial parts of it;
• use the Service to develop a competing product, or use output of the Service to train machine-learning models;
• remove or alter any copyright, trademark, or other proprietary notices;
• interfere with or disrupt the Service, circumvent security or access restrictions, or attempt to gain unauthorized access to systems or data.

10. User Content and Community Rules

Your content. The Service may allow you to submit content such as food logs, photos, training data, recipes, messages, blog posts, reviews, and success stories (“User Content”). You retain ownership of your User Content.

License to us. By submitting User Content, you grant 2fuel a non-exclusive, irrevocable, royalty-free, worldwide, transferable, sublicensable license to use, host, store, cache, reproduce, publish, display, perform, distribute, transmit, modify, adapt (including to conform to the requirements of networks, devices, or media through which the Service is available), create derivative works of, commercialize, and otherwise exploit your User Content in connection with the Service, including for the promotion and marketing of the Service.

• Where User Content contains personal data (including health-related data), our use of that data remains subject to the Privacy Statement and applicable data protection law; for marketing uses that identify you (such as success stories with your name or image), we will ask your separate consent.
• After termination of your account or removal of User Content, we may retain User Content for a commercially reasonable period for backup, archival, or audit purposes, and may retain and continue to use anonymized and aggregated data derived from it (section 13).

You are responsible for your User Content and warrant that it does not infringe anyone’s rights. User Content is not produced or verified by 2fuel and should not be relied on without independent verification.

Community rules. You may not post or share content that:

• is threatening, abusive, hateful, discriminatory, or harassing;
• promotes, glamorizes, or facilitates dangerously restrictive eating, eating disorders, or unsafe weight-loss techniques;
• promotes doping, performance-enhancing drug use, or anti-doping test avoidance;
• is illegal, fraudulent, misleading, or deceptive;
• infringes intellectual property, privacy, or other rights of third parties, or contains third parties’ personal data without their consent;
• solicits or advertises products or services without our consent;
• harms or solicits personal information from minors;
• impersonates 2fuel or any other person or entity.

We may (but are not obliged to) review, refuse, or remove User Content, and may suspend or terminate accounts that violate these rules (section 17). If you see content that violates these rules, report it to info@2-fuel.com.

11. AI Features

Parts of the Service use artificial intelligence technologies from third-party providers to generate recommendations, content, or responses (“AI Output”). You acknowledge and agree that:

• AI Output may be inaccurate, incomplete, or contain errors, and is not guaranteed to reflect facts;
• AI Output is general information, not professional (medical, dietary, or other) advice; do not rely on it as a sole source of truth and evaluate it before acting on it;
• AI Output may not be unique; similar output may be provided to other users;
• you will not use the AI features to generate content that infringes the rights of others or violates these Terms.

12. Third-Party Services and Integrations

The Service can connect with third-party platforms and devices (such as training platforms and activity trackers). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services, or for changes to their interfaces that affect the Service. Recommendations in 2fuel are only as accurate as the data these integrations provide.

13. Intellectual Property

The Service and all content made available through it by 2fuel — including software, design, text, images, audio, video, recipes, algorithms, and trademarks — are protected by intellectual property rights held by 2fuel or its licensors. Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.

You grant 2fuel the right to use data generated by your use of the platform in anonymized and aggregated form (so that it can no longer identify you) for analytics, research, and improvement of the Service.

14. Privacy and Health Data

We process personal data in accordance with our Privacy Statement.

Health data. To provide the Service, 2fuel processes health-related personal data, such as your weight, height, body composition, allergies and intolerances, dietary habits, and training and performance data. Under the GDPR this is a special category of personal data that we may only process with your explicit consent.

• During onboarding we ask your explicit consent to process this health data. You cannot use the Service without giving this consent, because the Service cannot calculate nutrition guidance without it.
• You may withdraw your consent at any time (via the app or by contacting info@2-fuel.com). Withdrawal does not affect the lawfulness of processing before withdrawal, but without this data we can no longer provide the core functionality of the Service, and withdrawal may therefore mean that your account is closed.
• If you use the Service together with a Coach or team, you control which data you share with them; Coaches are independently responsible for their handling of your data in their professional capacity.

You can request deletion of your data as described in the Privacy Statement and on our Delete Data page.

15. Liability

• We take care in developing and operating the Service, but the Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, or free of defects, or that content (including nutrition calculations and recipes) is always accurate, complete, or current.
• You are solely responsible for the safe handling, preparation, storage, and consumption of food, and for checking recipes and products for allergens and intolerances relevant to you. We accept no liability for health issues arising from allergens or from your handling or preparation of food.
• To the maximum extent permitted by applicable law, we are not liable for indirect or consequential damage, including lost profits, loss of data, or damage related to illness, injury, or (sports) performance resulting from use of the Service, coaching received via the platform, or reliance on content in the Service.
• To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or in connection with the Service is limited to the amounts you paid to 2fuel for the Service in the 12 months preceding the event giving rise to the claim.
• Nothing in these Terms limits or excludes our liability for damage caused by our intent (opzet) or deliberate recklessness (bewuste roekeloosheid), or any other liability that cannot be excluded or limited under mandatory law. These Terms do not affect your statutory rights as a consumer.

16. Indemnification

To the extent permitted by applicable law, you will indemnify and hold 2fuel harmless from third-party claims, damages, and costs (including reasonable legal fees) arising out of or relating to: (i) your use of the Service; (ii) your User Content; or (iii) your breach of these Terms or applicable law. For Coaches, this includes claims by your clients relating to your coaching services.

17. Term, Cancellation, and Termination

• These Terms apply for as long as you use the Service.
• By you. You can stop using the Service and delete your account at any time in the app (Account → Delete Account). Deleting your account does not automatically cancel a paid subscription purchased through an app store — cancel that in your app store settings.
• By us. We may suspend or terminate your account, with immediate effect, if you materially breach these Terms (including the community rules and payment obligations), if we are required to do so by law, or in case of (suspected) abuse or fraud. Where reasonable, we will warn you first and give you the opportunity to remedy the breach. For Beta Access, section 8 applies.
• We may discontinue the Service (in whole or in part). For paid plans we will give you at least one month’s notice and refund the pro-rata part of any prepaid fees for the period after discontinuation.
• Provisions that by their nature should survive termination (including sections 13, 15, 16, and 20) survive.

18. App Stores

If you downloaded the app from the Apple App Store or Google Play: these Terms are an agreement between you and 2fuel, not with the app store. The app store has no obligation to provide maintenance or support for the app and is not responsible for claims relating to the app. Apple and Google (and their subsidiaries) are third-party beneficiaries of these Terms with respect to your license to the app, and may enforce these Terms against you in that respect. You must also comply with the applicable app store terms.

19. Changes to the Service and These Terms

We may amend these Terms. For significant changes — including price changes — we will notify you at least two weeks in advance via the app or the email address linked to your account. By continuing to use the Service after the changes take effect, you accept the amended Terms. If you do not accept them, you must stop using the Service; for paid plans you may cancel effective from the date the change takes effect.

20. General

• If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid provision that most closely matches its intent.
• We may assign our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets; you will be notified where required by law.
• These Terms are drawn up in English. If we provide translations, the English version prevails in case of conflict.
• These Terms, together with the Privacy Statement, constitute the entire agreement between you and 2fuel regarding the Service.

21. Governing Law and Disputes

These Terms are governed by Dutch law. Disputes will be submitted to the competent court of the District Court of Limburg, location Maastricht, the Netherlands. If you are a consumer, you may also rely on the mandatory consumer protection rules of your country of residence, and you may bring or face proceedings before the court that is competent under those mandatory rules. Consumers in the EU can also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
